Terms of Service

1. Who we are

The Service is operated by Riddle OÜ (registry code 17254064), Estonia, contact info@riddle.ee ("we", "us"). These Terms govern your use of the Aphilly AI product image studio ("the Service").

2. The Service

The Service is an AI product image studio for affiliate marketers. It lets you (a) discover Amazon bestselling products, (b) upload or select a product photo, (c) use AI to transform it into polished, ad-ready marketing visuals with an AI-generated title and description (a "pin"), and (d) download those pins — together with an Amazon affiliate link — to publish manually on the platforms of your choice. The Service does not post on your behalf. You are solely responsible for the images you upload and for how you publish and use the generated results, including any applicable advertising, intellectual-property, and consumer-protection rules.

2a. Amazon product data & affiliate links

Product discovery surfaces publicly available Amazon catalog data (product titles, images, ASINs, ranking) sourced through a third-party data provider. This data belongs to Amazon and/or the respective rights holders; we make no claim to it and provide it to help you identify products to promote. Each generated pin includes an Amazon affiliate link built from your own Amazon Associates tracking ID, which you set in your account settings. If you do not set your own tag, links may carry a default tag until you configure one — set your tag before publishing so that commissions are attributed to you.

You are responsible for maintaining an Amazon Associates account in good standing and for complying with the Amazon Associates Program Operating Agreement, including its rules on link usage, product images, and required disclosures. We are not a party to, and take no responsibility for, your relationship with the Amazon Associates Program or any commissions, holds, or terminations arising from it. Amazon is not affiliated with, and does not sponsor or endorse, the Service.

2b. Required affiliate disclosures (FTC)

When you publish a pin that contains an affiliate link, you are responsible for making all disclosures required by law and platform policy — including U.S. FTC endorsement-disclosure rules and Amazon's own disclosure requirements — clearly and conspicuously (for example, "As an Amazon Associate I earn from qualifying purchases"). The Service does not add these disclosures for you.

2c. AI-generated content

The images, titles, and descriptions the Service produces are generated by artificial intelligence. To produce them, the product image and description you provide are sent to our third-party AI provider (OpenAI). AI output can be inaccurate, unrealistic, or misleading — it may misrepresent a product's appearance, colour, size, materials, or features. You must review every output before you publish itand must not use one that misrepresents the product being promoted.

Machine-readable AI marking. Every image the Service produces carries machine-readable provenance signals identifying it as AI-generated — C2PA Content Credentials and an embedded SynthID watermark, applied by our AI provider and preserved unaltered through our storage and download pipeline. This satisfies the machine-readable marking requirement of Article 50(2) of the EU AI Act. Re-encoding, screenshotting, or editing a downloaded image in other software may strip the C2PA metadata.

Visible labelling is yours. The Service does not apply a visibleAI label or watermark to outputs. Where the law or a publishing platform requires AI-generated content to be visibly disclosed at the point of publication, you are responsible for applying that label. This includes deepfake-disclosure obligations under Article 50(4) of the EU AI Act and the AI-content policies of platforms like Pinterest, Instagram, and TikTok.

3. Accounts

You sign in with Google. One account per person. You must be at least 18 years old and legally able to enter into a contract to use the Service. You are responsible for activity under your account. We may suspend accounts that abuse the Service (scraping, fraud, referral abuse).

4. Credits, payments & refunds

The Service runs on credits. Prices are shown at checkout; where required, VAT is calculated and added at checkout based on your location, and is shown before you confirm payment.

What a credit costs. Credits are digital goods that are consumed when you generate a result. The number of credits a generation costs depends on the image quality you choose — a standard (HD) image costs one credit and a higher-quality (Ultra) image costs two. Resizing a generated image into an additional size costs one credit per size. The exact credit cost of what you are about to generate is always shown in the app before you confirm, and is deducted only when you submit.

Expiry and reset. Purchased credits do not expire while your account is open. Subscription-allowance credits are separate: they are reset, not topped up, at the start of each allowance period, so any unused allowance is lost and never accumulates. See §5 for how often each plan's allowance resets. When you generate, allowance credits are spent before purchased credits, so your purchased balance is preserved for as long as possible.

Refunds. If you have purchased a credit pack and have not consumed a single credit from that purchase, you may request a full refund of that purchase within 14 days by emailing info@riddle.ee. Once you have consumed any credit — even one — that purchase is no longer refundable, because the credits are digital content supplied and consumed on demand. This applies to one-time credit-pack purchases. Subscription fees already charged for a completed or in-progress billing period are non-refundable; you cancel future renewals as described in §5.

EU/EEA right of withdrawal. If you are a consumer in the EU/EEA, you normally have a 14-day right to withdraw from a purchase of digital content. Because credits are made available for immediate use, at checkout you expressly request that we begin performance immediately and acknowledge that you lose your right of withdrawal for a credit pack once you consume any credit from it. Until you consume a credit, your 14-day withdrawal right is unaffected and a full refund is available as described above.

5. Subscriptions

How often your allowance resets. Subscriptions are billed monthly. How often the included credit allowance resets depends on the plan and is not always the same as the billing period: on most plans the allowance resets monthly, but on plans identified on the pricing page as having a weekly allowance (currently Scale), the allowance is reset every Monday to that plan's weekly figure while billing remains monthly. In both cases the allowance is reset rather than added: unused allowance credits do not carry over to the next week or month. A plan's per-month figure shown for comparison is the total across the period, not an amount available all at once. Purchased credits are unaffected by any reset.

Subscriptions renew automatically until canceled. You can cancel at any time from your account (Manage subscription → Stripe Billing Portal); access and the allowance continue until the end of the paid period, after which the allowance is removed and purchased credits are retained. Renewals are charged automatically at the start of each period at the then-current price for your plan using your saved payment method. If we change the price of a plan, we will notify you in advance and the new price will apply only from your next renewal; you may cancel before then if you do not agree. If a renewal payment fails, we may retry it and may suspend the allowance until payment succeeds.

5a. Referral program

We may offer a referral program that rewards you in credits when someone you refer makes a qualifying purchase. Referral rewards are credits only — they have no cash value, cannot be withdrawn, exchanged, or transferred, and are not refundable. A referral qualifies only where the referred person is a genuinely new user who completes a purchase that is not later refunded or charged back. We may withhold or reverse rewards from self-referral, duplicate or fake accounts, or any attempt to manufacture referrals, and may remove anyone from the program for such abuse. We may change or end the referral program at any time; credits already validly granted are unaffected.

5b. Changes to the Service

We may add, change, or remove features as the Service develops. If we make a change that materially reduces functionality you have already paid for, or if we discontinue the Service entirely, we will give you reasonable advance notice by email or in-app, stop selling new credits, and give you a period to use or request a refund of your unspent purchased credits. Nothing in this section allows us to keep payment for something we never deliver.

6. Acceptable use

You must not generate infringing, trademarked, deceptive, or adult imagery, misrepresent a product, use the Service to violate the Amazon Associates Program Operating Agreement or any publishing platform's terms, or use it in violation of any law. You must not scrape, bulk-export, resell, or redistribute the Amazon product data surfaced through the Service except as needed to create and publish your own pins.

You further agree not to: (a) attempt to circumvent credit, rate, or usage limits; (b) probe, scan, or interfere with the security or integrity of the Service; (c) use automated means to access the Service outside its intended interface; (d) upload content you do not have the rights to use, or that infringes any third party's intellectual-property, privacy, or publicity rights; or (e) resell or provide the Service to third parties as your own. We may remove content and suspend or terminate accounts that breach this section.

7. Intellectual property

Your inputs. You retain all rights in the product photos and other content you upload. You represent that you have the rights necessary to upload that content and to create marketing images from it — including, where a product image originates from Amazon or a third party, the right to use that image for your promotion.

Your outputs. As between you and us, and to the maximum extent permitted by law, we assign to you all rights we may have in the images, titles, and descriptions the Service generates for you (the "outputs"), so that you may use, modify, and publish them for any lawful purpose, including commercial affiliate marketing. We may retain and use outputs only as needed to operate the Service (for example, to store them for your download and to provide support); we do not claim ownership of your outputs.

No IP warranty on outputs. AI-generated outputs are produced from your inputs by third-party AI models. We do not warrant that any output is original, or that using or publishing it will not infringe a third party's trademark, copyright, design, or other rights — for example, where an underlying product, logo, or packaging is itself protected. You are responsible for reviewing each output and for ensuring your use of it is lawful before you publish it.

Our IP. The Service itself — its software, design, and branding — remains ours. These Terms grant you no rights in our trademarks or software beyond using the Service as permitted.

Reporting infringement. If you believe content stored or generated on the Service infringes your intellectual-property rights, email info@riddle.ee with the subject "IP complaint", identifying the content, your rights in it, your contact details, and a statement that your complaint is made in good faith. We will review it promptly, remove or disable access to content where the complaint is substantiated, and notify the affected user so they can respond. Repeat infringers lose their accounts.

8. Disclaimers & liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, that discovered products or AI-generated text will be accurate or suitable, or that using outputs will produce any particular commercial result or affiliate income.

We offer no uptime guarantee and no service-level agreement, and no guaranteed support-response time. Generation depends on third-party AI and data providers, so it may be delayed, rate-limited, degraded, or temporarily unavailable for reasons outside our control. If a generation fails for a technical reason on our side, we will restore the credits it consumed — that is your remedy for a failed generation.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost affiliate commissions, lost data, or loss of goodwill. Our total aggregate liability arising out of or relating to the Service and these Terms is limited to the greater of (a) the total amounts you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) EUR 50. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer.

Indemnity. You agree to indemnify and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your content, your outputs, your publication of pins, your affiliate activity, or your breach of these Terms or of the Amazon Associates Program Operating Agreement.

9. Termination

You may delete your account at any time (Account → Privacy & data → Delete account). Deleting your account removes your stored images, so download anything you want to keep first — we cannot recover it afterwards. We may suspend or terminate your account for breach of these Terms. Except where you have committed fraud or abuse, or where immediate action is needed for legal or security reasons, we will tell you why and give you a reasonable opportunity to respond and to export your generated images before we close the account.

Unspent purchased credits. If you close your own account, or we terminate it for a reason other than your fraud or abuse, you may request a refund of your unspent purchased credits (not allowance credits, which have no cash value) by emailing info@riddle.ee within 60 days. Refunds are calculated at the price you actually paid for those credits and are not issued automatically — you need to contact us, because account closure alone does not tell us you want one. If we terminate your account for fraud, referral abuse, or a serious breach of §6, unspent credits are forfeited. This does not affect any mandatory refund rights you have as a consumer.

10. Governing law & changes

These Terms are governed by the laws of Estonia, and the courts of Estonia have jurisdiction, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence, which continue to apply. We may update these Terms; material changes will be notified in-app and will require you to accept the updated Terms before you continue using the Service.

11. Complaints & dispute resolution

If something goes wrong, email info@riddle.ee first — we aim to respond to complaints within 14 days. If you are a consumer in the EU/EEA and we cannot resolve it between us, you may refer the dispute to the European Consumer Centres Network (ECC-Net), which puts you in touch with the consumer centre in your own country, or, if you are resident in Estonia, to the Consumer Disputes Committee of the Estonian Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet). Both routes are free and neither affects your right to go to court.
